Dems Counting on SCOTUS to Balance Redistricting Before 2020

Unlike last term, when an evenly divided court sidestepped or deadlocked on many contentious cases, this term - following Justice Neil Gorsuch's April confirmation - the court runs headlong into controversy. Prior cases demonstrate that some justices believe partisan gerrymandering is a "nonjusticiable" question that should not be decided by the courts. Justice Anthony Kennedy countered that the answer depends on the matter at issue on the sign.

The newcomer on the court, Gorsuch, will also be under the microscope in his first full session.

Since the case focuses on "extreme" partisan gerrymandering, locking in political majorities for multiple election cycles, it may be easier for the justices to avoid a sweeping opinion, some experts say.

"I'm obviously disappointed by what the court did [in Texas]", Holder said. The Brennan Center for Justice says the efficiency gap "counts the number of votes each party wastes in an election to determine whether either party enjoyed a systematic advantage in turning votes into seats". The Wisconsin map "was the most partisan" map possible.
