The Trend Toward Legalizing Recreational Marijuana

Nationwide, polls are showing support for pot is at an all-time high.

Arizona, California, Maine, Massachusetts and Nevada are considering legalizing recreational marijuana. Marijuana ballot initiatives could get people who've done time for drugs back on their feet. Meanwhile, the outcome of the vote in California is irrelevant, because this summer the state legislature passed a number of gun-control laws implementing even stricter sanctions than those being considered on the ballot.

But voters are less agreeable about competing death-penalty initiatives - with 51 percent supporting Proposition 62 to abolish the practice; and 48 percent in favor of Proposition 66, which would speed up executions.

Hillary Clinton has promised to move marijuana from Schedule 1 of the Controlled Substances Act (for drugs like heroin and LSD that have no accepted medical use) to Schedule 2, which includes opioid drugs that are medically useful but have a "high potential for abuse". The number of retail shops would be capped at 10% of the total number of liquor store licenses in the state, which is now less than 180.

Prop. 205 would legalize adult recreational marijuana use, cultivation and sales, with a 15% sales tax to fund new state regulation, enforcement and education efforts. Non-commercial transactions and/or retail sales involving medical cannabis would not be subject to taxation.

Of those questioned, 48 percent said they are likely to support the initiative, with 47 percent opposed and the balance undecided.

"I've been a long-standing advocate for allowing states to make medical marijuana available to patients under a doctor's recommendation to alleviate painful suffering". Now 25 States and District of Columbia have legislated the use of marijuana but only four States and DC allow its recreational use.

Research released earlier in September noted that opioid use has dropped in 21- to 40-year-olds, but this was only true for those who lived in states where medical marijuana is legal. However, the measure is presently trailing in the polls. Alaska and OR voters approved it in 2014.

Many of the California communities hoping to cash in on recreational marijuana formed their plans after meeting with David McPherson of HdL Companies, a Southern California consulting firm specializing in revenue strategies for local governments. They can have under 10 ounces in their home and under 1 ounce in public and be allowed to grow six plants. Alcohol sellers question if voters can handle both.

Passage of Prop. 64 would allow California adults 21 years and older to possess up to 1 ounce of marijuana or 8 grams of concentrate at any given time.

Based on polling data, the measure is likely to pass.

Much of the campaign to date has been focused on what has happened in Colorado where voters approved legalization for recreational use four years ago.

According to The Boston Globe, legalization has created thousands of new jobs and brought in $135 million dollars in state coffers in 2015.

On Election Day, it will appear on the ballot in nine states.

On Election Day, voters will also choose between executing them more quickly or mandating that they die of other causes in prison.
