Judges to hear appeal of Hawaii's travel ban win

A statement calling for a "complete and total shutdown" of Muslims entering the U.S. was apparently removed from President Donald Trump's official campaign website after a reporter asked about it at a press briefing on Monday. That call, which was still online earlier Monday, appeared to have been taken down by the afternoon hearing.

The administration appealed a March 15 ruling by Maryland-based federal judge Theodore Chuang that put the ban on hold just a day before it was due to go into effect.

"Alliance for Justice has serious concerns about Judge Thapar's fitness for elevation to a higher court, and urges senators and the public to closely scrutinize his record", the group said.

He added: "We've been very consistent since the first day of this administration on this".

No ruling was expected on Monday and it was unclear when the court would rule.

"The Muslim and refugee ban is a clear example of politics of hate and xenophobia", said Marielena HincapiƩ, the executive director of the National Immigration Law Center.

The Fourth Circuit used to be much more conservative until President Barack Obama began stacking the court with left-leaning judges.

Judge Robert King referred to a page on Trump's website as evidence that he's never "repudiated what he said" about wanting to ban Muslims from traveling into the U.S.

Trump has struggled in court as judges have halted his first travel ban and his attempt to block some federal funding to cities that fail to cooperate with immigration agents.

The administration argues that the court shouldn't question the president's national security decisions based on campaign promises. The other two were appointed in 1999. The three judges assigned all are Democratic appointees.

After the five judges are announced on Monday, the Trump administration will reportedly continue to periodically roll out even more conservative names until all of the vacancies are filled.

"Is the executive not entitled to some deference?" asked Judge Dennis W. Shedd.

"I don't know where it ends", said Judge Paul Niemeyer. Wynn asked in reference to some of Trump's comments. He noted that the attorney general and homeland security secretary have said in their judgment that the extreme vetting policy is needed.

"The question in this case is what is the objective of the order, whether it's legitimate or not", Mr. Jadwat said. He said Mr. Trump has shown animus toward Muslims that colors his actions. Gorsuch was on a list of potential candidates Trump released during his campaign. And the government is saying that the Justice Department - or the Justice Department is arguing that the president has enormous power when it comes to national security at the border.
