Judges to hear appeal of Hawaii's travel ban win

A calling for a "complete and total entering the U.S. was from President Donald Trump's official campaign after a reporter asked about it at a press briefing on Monday. That call, which was still online earlier Monday, appeared to have been taken down by the afternoon hearing.

Judge Robert King referred to a page on Trump's website as evidence that he's never "repudiated what he said" about wanting to ban Muslims from traveling into the U.S.

Trump has struggled in court as judges have halted his first travel ban and his attempt to block some federal funding to cities that fail to cooperate with immigration agents.

The administration argues that the court shouldn't question the president's national security decisions based on campaign promises. The other two were appointed in 1999. The three judges assigned all are Democratic appointees.

After the five judges are announced on Monday, the Trump administration will reportedly continue to periodically roll out even more conservative names until all of the vacancies are filled.

"Is the executive not entitled to some deference?" asked Judge Dennis W. Shedd.

"I don't know where it ends", said Judge Paul Niemeyer. Wynn asked in reference to some of Trump's comments. He noted that the attorney general and homeland security secretary have said in their judgment that the extreme vetting policy is needed.

And the government is saying that the Justice Department - or the Justice Department is arguing that the president has enormous power when it comes to national security at the border.
